Non-resident landlord in Portugal: 2026 tax and the fiscal representative

What you pay on Portuguese rent from abroad, how you file, and when you can skip the fiscal representative. Better than most pages suggest. Not tax advice.

If you live abroad and let a property in Portugal, two questions matter: what tax you pay on the rent, and whether you still need a fiscal representative. The 2026 answers are better than most English-language pages suggest.

The tax on your rent

A non-resident's Portuguese rental income is taxed under the same rules as a resident's: the autonomous rate is 25% for housing, but since 2026 a reduced 10% rate applies to housing rents up to €2,300 a month (Decree-Law 97/2026, article 45.º-C of the EBF). Because non-residents fall under the same CIRS article, the 10% should apply to them too, though the tax authority has not yet issued a specific note for non-residents, so confirm your case.

As a rough sense of scale, a flat let at €2,025 a month pays about €2,290 a year at 10%, instead of about €5,726 at 25%.

How you file

Curious what your flat could earn? For landlords

You file a Modelo 3 return with Annex F, declaring the Portuguese rent. EU or EEA residents can instead opt to be taxed at the progressive rates on their worldwide income (CIRS art. 72.º n.º 15), which occasionally helps.

The fiscal representative, often avoidable

A fiscal representative is required only for landlords resident outside the EU or EEA (for example the UK, Switzerland, the US, Brazil or Angola), and even then you can skip it by joining the tax authority's electronic notifications. Inside the EU or EEA it is never required (LGT art. 19.º, as amended by Decree-Law 44/2022).

Who does the work

From abroad, the real burden is the admin: rent receipts, the Modelo 2, stamp duty, and an annual statement shaped for your Annex F. LOFTZ can handle all of it, or lease your property from you on guaranteed rent with the tax withheld at source. See the options for landlords.
